If we learn that someone under 18 is using our Services, we will terminate their account immediately and delete any associated data.

We may modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

4. Not Professional Advice

Ember is not a substitute for professional therapy, counseling, or medical advice.Our Services are designed for educational and entertainment purposes to help couples explore their relationships.

The content provided through our Services, including AI-generated responses, should not be relied upon as professional advice. If you are experiencing relationship difficulties, mental health concerns, or other issues requiring professional help, please consult a qualified therapist, counselor, or healthcare provider.

We make no guarantees about the outcomes of using our Services. Your relationship results depend on many factors beyond our control.

5. Your Account

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information
  • Notifying us immediately of any unauthorized access

Your account is personal and non-transferable. You may not share your account with others or allow others to access your account.

6. Subscriptions and Payment

Some features of Ember require a paid subscription ("Premium"). By subscribing to Premium:

  • You authorize us to charge your payment method on a recurring basis
  • Your subscription will automatically renew unless you cancel before the renewal date
  • You can cancel your subscription at any time through your account settings
  • Refunds are handled in accordance with our refund policy and applicable law

We may change our subscription prices at any time. If you are an existing subscriber, we will provide notice before any price increase takes effect.

All payments are processed securely through Stripe. We do not store your full payment card details.

7. User Content

You retain ownership of the content you submit to Ember, including quiz responses, chat messages, and profile information ("User Content"). By submitting User Content, you grant us a limited license to use, store, and process this content solely to provide and improve our Services.

You are solely responsible for your User Content. You represent that you have all necessary rights to submit such content and that it does not violate any third-party rights or applicable laws.

We may use anonymized and aggregated data derived from User Content for research, analytics, and service improvement purposes.

8. Partner Sharing

Ember allows you to connect with a partner and share certain information. You control what information is shared with your partner through our privacy settings. By connecting with a partner:

  • You consent to sharing the information you choose to make visible
  • You acknowledge that your partner may see compatibility scores and shared responses
  • You can disconnect from a partner at any time

We are not responsible for how your partner uses information you choose to share with them.

9. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm another person
  • Share content involving minors in any sexual context
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

We may suspend or terminate your access to our Services at any time, with or without cause, including if we believe you have violated these Terms. You may also terminate your account at any time by contacting us.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee any specific results from using our Services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts located in Delaware.
